Terms of Service

These terms govern your use of Perkly, a points-based loyalty and rewards app for OpoShop merchants, published by Found ("we", "us"). By installing or using Perkly, you ("the merchant") agree to these terms. If you don't agree, don't install or use the app.

The service

Perkly lets an OpoShop merchant run a points-based loyalty program: customers earn points on orders and other configured actions, and redeem those points for money off at checkout. Perkly reads store data through OpoShop's API to award points and creates discounts to apply redemptions. Features may change, improve, or be discontinued as the product evolves.

Your account & store

• You must have an OpoShop store and the authority to install apps and configure loyalty for it.
• You're responsible for the settings you choose — the earning rate, redemption value, tier thresholds, and bonus rules — and for the loyalty program those settings create for your customers.
• You're responsible for keeping your OpoShop account credentials secure. Activity through your connected store is your responsibility.

Points, balances & your obligations to customers

• Points issued through Perkly represent a promise you make to your customers, not a payment instrument or cash. Outstanding points are a liability you owe your members; Perkly helps you track that liability but does not assume it.
• You're responsible for honoring balances you've issued and for the terms of your own loyalty program, including any rules on earning, expiry, or redemption you communicate to customers.
• Loyalty programs, points, and reward-expiration rules can be regulated differently by region. You're responsible for complying with the laws that apply to your business and customers.

Acceptable use

• Don't use Perkly to break the law, infringe others' rights, or violate OpoShop's terms.
• Don't attempt to access another store's data, reverse-engineer the service, disrupt it, probe it for vulnerabilities, or exceed reasonable rate limits.
• Don't use Perkly to issue points fraudulently, manipulate balances, or otherwise misuse the loyalty ledger.

Third-party platform

Perkly runs on top of OpoShop and depends on OpoShop's platform, APIs, checkout, and discount engine, which we don't control. We're not responsible for OpoShop's availability, changes, pricing, or actions, or for any interruption or data loss caused by the platform. Your use of OpoShop is governed by OpoShop's own terms.

Availability & no warranty

We work to keep Perkly reliable, but the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that it will increase your sales or retention.

Limitation of liability

To the maximum extent permitted by law, Found will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of Perkly. Our total liability for any claim relating to the service is limited to the amount you paid us for Perkly in the three months before the claim (which may be zero, as Perkly installs free).

Termination

You may stop using Perkly and uninstall it from your OpoShop admin at any time. We may suspend or end access if these terms are violated or if required to protect the service or other merchants. On uninstall, we stop processing new activity for your store; data handling on termination is described in our Privacy Policy.

Changes to these terms

We may update these terms as the product evolves. Material changes will be reflected here with a new "last updated" date; continuing to use Perkly after a change means you accept the updated terms.
